Wadia Ghandy Advised NAREDCO West In NGO’s Petition Against DCPR 2034

Wadia Ghandy & Co. Represented NAREDCO West Foundation in a Writ Petition filed by NGO Alliance for Governance and Renewal (NAGAR) before the Bombay High Court challenging Regulation 17(3)(D)(2) of Development (Control and Promotion) Regulations for Greater Mumbai, 2034 (DCPR) dealing with implementation of slum rehabilitation schemes on land which has any area thereof reserved as non-buildable/open spaces under the Development Plan.

The Bombay High Court has dismissed the challenge of the Petitioners to the aforesaid regulation and upheld the validity of the same. Additionally, the High Court has passed certain directions for the purposes of identifying and preserving open spaces whilst implementing such slum rehabilitation schemes.
