The Fort Circle Successfully Defended Bandra Gymkhana’s Managing Committee Before Civil Court

The Fort Circle successfully defended the Bandra Gymkhana and its Managing Committee in a dispute concerning the removal of the President of the Managing Committee (Plaintiff) filed before the City Civil Court, Dindoshi, Mumbai.

In an application filed by the Plaintiff seeking interim relief to restrain the implementation of the members’ resolution to remove the Plaintiff from the post of the President and restore her to office, the Court held that no prima facie case or irreparable injury had been established by the Plaintiff.

In doing so, the Court reaffirmed the importance of respecting the democratic will of members, adherence to an association’s governing rules, and the settled principle that final reliefs cannot ordinarily be granted at an interim stage.
