Wadia Ghandy Successfully Represented MIAL Before Bombay HC & Supreme Court

Wadia Ghandy & Co represented Mumbai International Airport Ltd. (MIAL) in eviction proceeding initiated in respect of Air India Housing Colony, Kalina. These proceedings commenced before the Eviction Officer under the Airports Authority of India Act, 1994, (AAI Act) culminating in eviction orders being passed against 156 unauthorized occupants.

First Appeals filed against the eviction orders were dismissed in a landmark judgment which upheld the applicability of the AAI Act and the validity of the proceedings initiated by MIAL. The Bombay High Court held that the leave and license arrangement stood duly terminated and the employees of the erstwhile Air India cannot claim any rights in the Housing Colonies and are directed to vacate the premises.

The Supreme Court has dismissed the SLP filed by the employees and directed the employees to hand over vacant and peaceful possession of the premises to MIAL on or before 30.11.2025.
