Following the tragic fire at Hotel Rituraj in Kolkata, the Kolkata Municipal Corporation (KMC) issued demolition and closure notices to several rooftop cafés operating in violation of KMC Building Rules.
These actions were challenged before the Calcutta High Court by the Restaurant Association, along with three affected rooftop cafés. Fox & Mandal successfully represented KMC in these proceedings, with the Court directing the rooftop cafés to cease operations in light of public safety concerns.
The Court also instructed KMC to re-verify facts and provide an opportunity for a hearing before taking any final demolition-related actions. This judgment underscores the importance of adhering to municipal regulations to ensure public safety and effective disaster management.
